However, the carrier is not prohibited from determining the reimbursement based on geographic location of the service or the preeminent qualifications of the physician/podiatrist. Consolidation through mergers and acquisitions in the steel industry is likely to result in higher steel prices for automotive producers. Already in the last year, companies like United States Steel Corp. and AK Steel Holding Corp. raised contract prices on steel as a falloff in industry capacity and tariffs on imports of foreign steel helped prices rebound from 30-year lows. For years, U.S. steel companies, which supply most of the steel used by Big Three automakers were unable to raise contract prices as competition from cheap foreign imports kept steel prices low. The tables turned last year, however, as steel prices rose when several bankrupt steelmakers liquidated — removing a chunk of industry capacity — and the federal government slapped hefty tariffs on imports of foreign steel. The auto industry has since condemned the tariffs, saying the added costs have forced companies to cut jobs and consider importing steel from countries exempt from the tariffs. Ana Lopes, director of government relations for the Motor and Equipment Manufacturers Association, which represents the automotive parts industry, said steelmakers have “unilaterally voided terms or prices of many steel contracts” as the steel costs rose anywhere from 20 to 60 percent in the last year.

Charles Grassley (R-Iowa) introduced bankruptcy reform legislation, S. 256, that would increase the liability and administrative burdens of bankruptcy attorneys under the Bankruptcy Code. The formal name for recycled carpet padding is bonded polyurethane foam, or re-bond carpet padding. You cant mistake it. Its the multi-colored padding made up of chopped and shredded pieces–pieces of used carpet padding combined with postindustrial polyurethane foam scrap. According to the Carpet Cushion Council, Riverside, Conn., recycled carpet padding now accounts for 80 percent of all carpet padding sold in the United States. Remarkably, more than 50 percent of all used and removed carpet padding in the United States is recycled and used to make new re-bond carpet padding, as reported by the National Association of Home Builders Research Center. This level of recycling is approaching the phenomenal success of asphalt and concrete recycling, or certainly the aluminum can recycling in the United States which, according to the Aluminum Association, recycles between 53 and 54 percent of all aluminum beverage cans shipped.

The national estimate of recycled, post-consumer carpet padding scrap amounts to 62,500 tons per year. Thats enough used carpet padding to create a 50-foot wide roll stretching from Los Angeles to New York City (or enough to cover almost 12,000 football fields)–a significant amount of material that could otherwise be landfilled.
Contract carpeting is the specialty at Burmatex, Ossett, U.K., which has been in the carpet business for more than 25 years. The company, which manufactures both needlepunched and tufted carpets and carpet tiles, has a broad product line that includes velours, sport carpets, entrance carpets where effective dirt barriers are needed, academic institution carpets and high end office carpeting. Needlepunched carpets make up 80% of production. The company had its roots in textile waste processing, from which it diversified in the 1960s, making carpet production the core business. Burmatex is a member of the Sirdar Group. The bulk of the companys business is sold into the British market, but it has in recent years been working on increasing its export business. Currently about 12% of sales are outside the U.K., with 6% outside Europe. Like most companies, Burmatex has felt the pressures of the recession and is struggling through its first downturn in 20 years; however, it maintains a policy of constantly upgrading and expanding facilities. Burmatex is predicting a sales increase of 5% for fiscal 1994. In keeping with its expansion goals, the company recently added a Tatham “Ambassador” 2.5 meter wide double doffer nonwoven card and “Laymaster” 2000 crosslapper, which incorporates micro-control technology and a computer controlled drive system. The line also includes Fehrer needlepunching machinery, including the Model NL9SRS downstroke/upstream loom and its structuring model NL11S. The new machinery, which is located in a new building at the companys Ossett site, was up and running in April and has increased production capability by more than 48,000 sq. meters. The line complements four existing nonwovens lines at Burmatex; total nonwovens capacity is approximately five million sq. meters per year.

Iowa uses the significant relationships test, a theory that the court should use the law of the state which has the most significant relationships to the matter and parties involved in the litigation.

quarters, according to results from Abrams Travel Data Services (ATD) just
released Car Rental Operator Benchmark Survey. This optimistic outlook is
one of several signs that the US car rental industry may be poised for a
strong year. These benchmark survey results, along with a 2004 forecast for
the US and European car rental industries, are part of the February edition
of Car Rental Market Scan, ATDs subscriber quarterly information service

ATD surveyed car rental operators geographically dispersed throughout the
US and that serve all segments of the industry including airport-based
rentals and non-airport/local markets. Car rental operators reported their

The NBERs Law and Economics Program studies the effects and causes of legal rules, with a special focus on the foundational legal subjects–property law, criminal law, contract law, and tort law–and on the operation of the legal process. In regard to the operation of the legal process, the Program examines topics such as labor markets for lawyers, litigation dynamics, judicial and agency behavior, and the determinants of legislative action. In addition, the Program studies the effects and causes of legal rules across a range of legal subjects beyond property, criminal, contract, and tort law, including corporate law, employment law, health care law, social welfare law, family law, bankruptcy law, patent and copyright law, and antitrust law. The Program meets twice per year, once at a mid-year program meeting and again at the NBERS Summer Institute. The Programs recent special activities include a project in the area of corporate governance, under the direction of Research Associate Lucian Bebchuk; selected papers from that project are scheduled to appear in a forthcoming issue of the Review of Financial Studies. In this article, I first describe recent research in the foundational legal subjects and then turn to work on the operation of the legal process. I conclude with an overview of work on the effects and causes of legal rules in corporate law, employment law, health care law, social welfare law, family law, bankruptcy law, patent and copyright law, and antitrust law. Property Law, Criminal Law, Contract Law, and Tort Law A fundamental aspect of any legal system is the structure of property rights. Recent work by Oliver Hart (13540) is the latest in an important line of papers by Hart, Sanford Grossman, and John Moore that examine the effects of a particular conception of property rights emphasizing “residual control.” In this view, the owner of an asset retains those rights to the asset that are not specifically assigned by any existing contractual commitment. While previous papers in the series have examined the effects of the residual control rights conception of property rights in the face of parties non-contractible up-front investments, the recent paper by Hart studies the effects of property rights of this form in a model with uncertainty of values and costs of a good to be traded. Harts model suggests that ex-ante contracting over asset ownership can reduce later incentives to engage in hold-up. A system that did not provide for property rights in the Grossman-Hart-Moore sense (reserving residual rights to the state rather than to the property owner) would be inferior within this framework.

The Oklahoma Foundation for Medical Quality was named Organization of the Year by the Rural Health Association of Oklahoma.
iHealth, an online suite of medical
practice web sites and secure patient email services provided by Medem is
now integrated with Google Health, a new product that allows users to
store, organize and manage their medical records and personal health
information online. Medem is a healthcare IT company founded by leading
medical societies, including the American Medical Association (AMA).
The iHealth collaboration with Google allows Google Health users to share
information in their Google Health profile with doctors using the iHealth
web product. This in turn helps keep doctors up-to-date on current medical
conditions and medications. Physicians who offer the iHealth service to
their patients will be listed in the Google Health “Find a Doctor” feature
as integrated with Google Health.
“Improving communication and strengthening the patient-physician bond is a

WITH regards to the comments made by a dog owner whose pet was attacked by a Staffordshire Bull Terrier - as an owner of this breed I would like to make a point that it is down to the owner of any breed of dog to be able to control their animal. My dog is a beloved family pet who is seven years old and has never bitten, nor indeed growled at another dog or person. As a puppy he was trained to know right from wrong and mixes with other dogs extremely well. So classifying all dogs of this breed as vicious hounds is inaccurate - it is the owners responsibility to train their dogs. Any breed can attack another dog or person if it is mistreated or not trained. To say the dogs have an unpredictable nature is wrong. Any dog can snap or get into a fight it all depends on how they have been brought up.

How do you know that the person you select to train your dog and solve those pesky problems is really qualified? Trainers, like dogs, come in all shapes, ages and sexes. There are almost as many training methods as there are dog breeds. One “expert” will tell you that the only way to train your dog is with treats — saying it is the only kind way to teach the basics. Another will be emphatic about clicker training — training your dog to jump through hoops to the sound of a click. Another will say, “Dont use a training collar because it will hurt your dog.” Then, that same person will whip out a pronged collar and declare that it is less abusive. People who train their own dogs suddenly hang out the “expert dog training” shingle. But the most interesting thing is that it is suddenly fashionable, not to mention profitable, for almost everyone who works with dogs to tack on the word “behaviorist” to their repertoire of services. This applies to an interesting array of would-be professionals from self- appointed dog trainers who have taught a dog or two to sit and stay to medical professionals like veterinarians. Now, I dont mean to imply that there are not people out there who are schooled in pet behavior. There are a few institutions of higher learning that are dealing with the subject and making incredible inroads. There are a few people, not many, who have some wise theories based on facts. But there are many more who make assumptions without input from those who have a lifetime of true experience. They dont do their homework nor do they research proven techniques. But because they have tacked on that little word “behaviorist,” no one questions their actions. For example, you know that the chain-link training collar is referred to as a “choke collar.” There are those who put it in the same category as the shock collar, suggesting that it is dangerous and may lead to fearful behavior and aggression. I have long believed that the shock collar is used by lazy trainers and owners or those who havent got a clue about dog behavior. But the training collar, when used properly to get the dogs attention, is the best way to communicate with a pooch in training. I tell my clients and students that it is the person on the end of leash who makes the difference, just like it is the driver, not the car. If you dont know how to use something, you can abuse it. But to put one of the safest and best training tools in the same category with abusive shock collars is irresponsible and not based on an understanding of the process.
